Secure Journeys: Exploring Child Visas for Lasting Residency in Australia

A child must obtain a visa if they do not hold a permanent visa and intend to travel to, enter, or stay in Australia indefinitely.

A child visa allows the holder to reside permanently in Australia if they are the child of an Australian citizen, Australian permanent resident, or an eligible New Zealand citizen.

There is also a temporary child visa available for children of temporary partner visas (Subclass 820 or 309).

Australian Child Visa Options

Depending on the applicant’s circumstances and their sponsor, there are various types of child visas:

  1. Child Visa (subclass 101)
  2. Child Visa (subclass 802)
  3. Dependent Child Visa (subclass 445)
  4. Orphan Relative (subclass 837)
  5. Orphan Relative (subclass 117)
  6. Adoption Visa (subclass 102)

When applying for a Child Visa (subclass 101) or Orphan Relative (subclass 117), the applicant must be outside Australia at both the time of application and grant.

When applying for a Child Visa (subclass 802) or Orphan Relative (subclass 837), the applicant must be inside Australia at both the time of application and grant.

For a Dependent Child Visa (subclass 445), the applicant can be in or outside Australia at the time of application. If in Australia at the application time, they must also be in Australia at the time of grant. If outside Australia at the application time, they must be outside Australia at the time of grant.

Except for Subclass 445, all the above visas are permanent and available to children or step-children of Australian citizens, permanent residents, or eligible New Zealand citizens. The Dependent Child Visa (subclass 445) is temporary and available to children or step-children of temporary partner visa holders (subclass 309 or 820). The Dependent Child Visa holder then transitions to a permanent partner visa (subclass 100 or 801) concurrently with their parent.

An orphan relative visa is for children unable to be cared for by their parents due to them being missing, deceased, or permanently incapacitated.

An adoption visa must be applied for outside Australia and requires adoption involvement from an Australian state or territory authority under the laws of a country other than Australia. The sponsor or sponsor’s partner must have lived outside Australia for the 12 months before the child applies for the visa.

Sponsorship

The applicant must be sponsored by an Australian citizen, a permanent resident of Australia, or an eligible New Zealand citizen.

For the Orphan Relative visa, the sponsor can be a relative who is an Australian citizen, a permanent Australian resident, or an eligible New Zealand citizen if they are a brother, sister, grandparent, aunt, uncle, niece, nephew, or step equivalent.

Age

  1. Under 18 years old, or
  2. Over 18 and under 25 years and studying full time, or
  3. Over 18 years with a disability

Meet the Health Criteria

The applicant is required to undergo a health assessment as part of the application. Meet the Character Criteria If the child is aged 16 years or over, they must meet the character requirement.
