If you find yourself in a sincere and committed relationship with an Australian citizen, Australian permanent resident, or eligible New Zealand citizen, you may qualify for a Partner visa. This visa category constitutes approximately 25% of Australia’s migration program, making it the largest segment in the family stream.

To be eligible to apply for the Australian Parent visa the application must be sponsored by children of the parents wishing to migrate to Australia, the children must be citizens or permanent residents of Australia, or eligible New Zealand citizen.

There are three main types of Partner visas:

Prospective Marriage Visa (subclass 300):

This visa allows entry into Australia for the purpose of marrying your prospective spouse, paving the way for the subsequent application for the Partner visa. Securing this visa is the initial step toward obtaining a temporary Partner visa (subclass 820).

Eligibility

    1. You must have met your partner in person.
    2. Be 18 years old or older.
    3. Sponsorship by your partner is required.
    4. An intention to marry your prospective spouse within 9 months of visa grant.

Partner (Provisional) Visa (subclass 309):

This visa permits the de facto partner or spouse of an Australian citizen or permanent resident to reside in Australia temporarily. Acquiring this visa is the preliminary stage leading to a permanent Partner Visa (subclass 100).

Eligibility:

  1. Normally, your relationship should have endured for at least 12 months before lodging the application. Dating or engaging in an online relationship may not be considered as being in a de facto relationship.
  2. Commitment to a shared life exclusive of others.
  3. The relationship must be genuine and ongoing.
  4. Cohabitation or the absence of living separately on a permanent basis is required.

Partner (Provisional) Visa (subclass 820):

This visa enables the de facto partner or spouse of an Australian citizen or permanent resident to reside in Australia temporarily. Obtaining this visa marks the initial phase towards securing a permanent Partner visa (subclass 100).

Eligibility:

  1. Generally, your relationship must have lasted for at least 12 months before lodging the application. Time spent in dating or an online relationship might not be considered as fulfilling the de facto relationship criteria.
  2. Commitment to a shared life exclusive of others.
  3. The relationship must be genuine and ongoing.
  4. Cohabitation or the absence of living separately on a permanent basis is required.
